In BM Abogados (“BMA”) we are aware, and we recognize the value of the treatment and use of personal information. BMA collects and uses certain personal information obtained through our website www.bmabogados.mx (“Website”), or personally, by phone and through electronic correspondence.

This Privacy Policy (“Policy”), as well as the information contained herein is issued according to the Federal Protection Law of Personal Data in Possession of Individuals, published in the Official Federal Gazette on July 5th, 2010; its Bylaws published on December 21st, 2011, and the Guidelines of Privacy Policy published on January 17th, 2013.

I. Collection and Use of Personal Data.

As a general rule, the data collected by BMA will be primarily: full name, e-mail, personal address and telephone number. BMA requests such information with the purpose of identify our clients in order to provide a personalized service.

The personal data that BMA also may collect and use, will be as follows: full name, e-mail, personal address, telephone number, workplace, photograph, signature, identification documents, passport and visa details, nationality, migratory status, tax identification number, job position, information regarding bank accounts, marital status, credit history, affiliations, as well as tax and corporate information.

Additionally, there is a possibility that certain sensitive information could be required, such as bank statements, financial information, and other private information. It’s important to mention that such information will be only collected when it becomes strictly necessary for the proper provision of our legal services to you.

II. Transfer of personal data.

As a general rule, your personal data will not be transferred to any person or entity and will be safeguarded at all times in our database. However, there may be a possibility that part of your data will be transferred to third parties that collaborate with BMA in financial, accounting and legal matters. In case of such transfer, BMA will communicate this Privacy Policy to such third parties, who will be bound by the terms and conditions of this policy.

III. Resources to enforce access, rectification, cancelation and objection rights of Personal Data (ARCO).

BMA informs that you have the right to access to your personal data that we collected and be informed of the treatment of such, as well as to rectify them in case that were inaccurate or incomplete, or cancel them at any time if they were excessive or unnecessary regarding to the purposes of use declared at the moment of their collection, as well as object the treatment of such data for specific purposes.

If you have provided any personal data for the aforementioned uses and wish to access, rectify, update, cancel, object or revoke them, you may do it at any time by written request addressed to our Personal Data Treatment Bureau, which can be delivered personally to the our contact address or by e-mail to info@bmabogados.mx.

The request must have the following requirements: full name and personal address, e-mail, identification documents, clear and simple description of the right claimed (reason of the notice) and in case of rectification, you must indicate the amendments and provide the documentation that supports the request.

In case that the aforementioned request be presented by a person other than the owner of the personal data, that person must proof the legal representation through a simple power of attorney signed by two witnesses, or through public deed, as well as a copy of the identification document of the owner of the personal data and its representative.

The request will be answered within 20 (twenty) business days after the date when BMA receives the request, and within that period we will notify you our answer by e-mail. BMA may request you to provide personally the original documents that you provided with the request; in that case, that documents shall be submitted within the following 5 (five) business days after the date we requested them. In case the original documents will not be provided in that period of time, the request will be filed, and your personal data will be treated according to this Policy.

If your request be authorized, it will be executed within the 15 (fifteen) business days after the date BMA notifies you such authorization.

We inform you that BMA may deny the exercise of the ARCO rights, in the following cases:

  • When the claimant is not the owner of the personal data or does not duly proof its representation.
  • When your personal data aren’t or can’t be found in our data base.
  • When the request may infringe third parties’ rights.
  • When there is legal impediment or an authority´s resolution that restricts your ARCO rights.
  • When the rectification, cancelation or objection has already been executed.

IV. Withdrawal of consent regarding the treatment of personal data.

At any moment you can revoke your consent of the treatment of your personal data; in that case, its required to file the corresponding request by e-mail to our email indicated in this Policy, detailing the reason of your request.

V. Use of Cookies and Web beacons.

We inform you that Cookies and Web beacons are pieces of information that the network site transfers to the individual system´s hard drive with the purpose to keep a record. Our Website does not use such mechanisms to collect any type of information.

VI. Amendments to the Privacy Policy.

In case of any amendments to terms of our Private Policy BMA will duly notify them through our Website www.bmabogados.mx.

In BMA we have implemented administrative, technical and physical politics and mechanisms that protect the personal data that you provide us, with the purpose of avoid losses, misuses, unauthorized access, publications, alterations or destructions of such personal data.
